Terms of Service

1. Acceptance of Terms
By accessing or using Jfali ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms apply to all users, including businesses that subscribe to the Service ("Clients") and their end-users (e.g. patients visiting a Client's website).
2. Description of Service
Jfali provides a multi-tenant website and practice management platform that allows Clients to create and manage a website, handle online bookings, collect patient enquiries, and send automated email communications. The platform is provided on a software-as-a-service basis.
3. Accounts and Onboarding
Client accounts are created by Jfali on the Client's behalf. Clients are responsible for maintaining the confidentiality of their login credentials. You must notify us immediately of any unauthorised access to your account. We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or regulation;
- Collect or process personal data without appropriate consent from data subjects;
- Send unsolicited commercial communications;
- Interfere with the security or integrity of the Service;
- Impersonate any person or entity.
5. Data and Privacy
Our collection and use of personal data is described in our Privacy Policy. As a Client, you are the data controller for your patients' personal data collected through the platform. We act as a data processor on your behalf. You are responsible for ensuring you have a lawful basis for processing patient data and for maintaining an appropriate privacy notice on your own site.
6. Payment and Cancellation
Pricing is agreed between Jfali and the Client prior to account creation. Billing terms, cancellation notice periods, and refund policies are set out in the individual agreement between Jfali and each Client. In the absence of a separate agreement, subscriptions are billed monthly and may be cancelled with 30 days' written notice.
7. Intellectual Property
All software, design, and content forming part of the Jfali platform remains the intellectual property of Jfali. Content you upload to the platform (e.g. logos, page text, images) remains your property. You grant Jfali a non-exclusive licence to host and display that content for the purpose of operating the Service.
8. Limitation of Liability
To the fullest extent permitted by law, Jfali's liability to you in connection with the Service shall not exceed the total fees paid by you in the 3 months preceding the event giving rise to the claim. Jfali is not liable for indirect, incidental, or consequential losses, including loss of data or business interruption.
9. Service Availability
We aim to maintain high availability but do not guarantee uninterrupted access to the Service. Scheduled maintenance will be communicated in advance where possible. We reserve the right to modify or discontinue any feature of the Service at any time.
10. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
11. Changes to These Terms
We may update these Terms from time to time. We will notify Clients of material changes via the email address associated with their account at least 14 days before changes take effect. Continued use of the Service after that date constitutes acceptance of the revised Terms.
